Canada FAQs

When does overtime start in Ontario?

Ontario overtime begins after 44 hours in a work week, paid at 1.5 times your regular rate. There is no daily overtime threshold in Ontario, meaning 12-hour shifts do not trigger overtime unless total weekly hours exceed 44.

How is BC overtime different from Ontario?

BC has both daily and weekly overtime. You earn 1.5x after 8 hours per day and double time (2x) after 12 hours per day. Weekly overtime is 1.5x after 40 hours. Ontario only has weekly overtime at 44 hours with no daily threshold and no double time provision.

What is the overtime rate in Alberta?

Alberta overtime is 1.5 times your regular rate after 8 hours per day or 44 hours per week, whichever comes first. Unlike BC, Alberta does not have a double-time provision.

Are salaried employees entitled to overtime?

It depends on your classification. Most salaried employees are entitled to overtime unless they are specifically exempt (managers, supervisors, certain professionals). Your overtime rate is calculated by dividing your salary by your standard hours.

Can my employer offer time off instead of overtime pay?

In most provinces, employers can offer compensating time off (banked time) at 1.5 hours for each overtime hour instead of cash payment. Both the employee and employer must agree to this arrangement in writing.

Does overtime apply to federally regulated workers?

Yes. Federally regulated industries (banking, telecom, transportation, broadcasting) follow the Canada Labour Code: overtime at 1.5x after 8 hours per day or 40 hours per week.
